These Terms & Conditions ("Terms") govern your purchase and use of services provided by Ellevated by Design LLC ("Company," "we," "our," or "us"). By purchasing any service from Ellevated by Design LLC, including the Content Kickstart offer, you agree to these Terms.
1. Services
Ellevated by Design LLC provides content editing, content strategy, creative consulting, and related digital marketing services.
The Content Kickstart service is a one-time digital service designed to provide edited content based on materials submitted by the client.
2. Client Responsibilities
To receive services, the client agrees to:
- Complete all required onboarding forms.
- Upload all requested content, footage, and assets.
- Provide accurate contact information.
- Ensure they have the legal right to use and submit all content provided.
The Company is not responsible for delays caused by missing information, missing assets, or incomplete onboarding submissions.
3. Turnaround Times
Project turnaround times begin once all required onboarding information, footage, and supporting assets have been received.
Estimated turnaround times are provided as guidelines and are not guaranteed.
4. Revisions
Each Content Kickstart purchase includes one revision round unless otherwise stated.
Revision requests must be submitted within seven (7) days of delivery.
Additional revisions beyond those included may be subject to additional fees.
5. Payments
All payments are due at the time of purchase unless otherwise agreed in writing.
Payments are processed through third-party payment processors, including Stripe.
6. Refund Policy
Due to the digital and custom nature of the services provided, all sales are final.
No refunds will be issued after work has begun, assets have been reviewed, or deliverables have been created.
7. Expiration of Services
Content Kickstart purchases must be redeemed within ninety (30) days of purchase.
If the client fails to submit onboarding information, footage, or required materials within ninety (30) days, the service may be considered abandoned and forfeited without refund.
8. Intellectual Property
Clients retain ownership of all original footage and materials they provide.
Upon final payment, clients receive ownership and usage rights to final deliverables created specifically for their project.
Ellevated by Design LLC retains ownership of all proprietary systems, templates, workflows, editing methodologies, training materials, and internal processes.
9. Portfolio Rights
Unless otherwise requested in writing prior to project commencement, Ellevated by Design LLC may display completed work, excerpts, screenshots, and related content for portfolio, marketing, promotional, educational, and business development purposes.
10. No Guarantees
The Company does not guarantee any specific business results, revenue increases, audience growth, lead generation, engagement metrics, conversions, or social media performance.
Results vary based on numerous factors outside the Company's control.
11. Limitation of Liability
To the maximum extent permitted by law, Ellevated by Design LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of its services.
The Company's total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.
12. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of California.
