These Terms of Service govern the services provided by Ellevated By Design. They contain two agreements:
Part 1 — Content Kickstart Agreement applies when you purchase a Content Kickstart.
Part 2 — Editing Membership Agreement applies when you purchase or upgrade to an Editing Membership.
By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by the terms applicable to that purchase, as set out below.

Please read this Content Kickstart Agreement carefully before purchasing your Content Kickstart. By completing your purchase, you acknowledge that you have read, understood, and agree to these terms.
The Ellevated By Design Content Kickstart is a one-time introductory service designed to allow you to experience our editing process before deciding whether to join one of our ongoing editing memberships.
Your purchase includes:
The Content Kickstart is a standalone service. Purchasing a Content Kickstart does not obligate you to purchase a monthly membership.
The quality of your edit depends heavily on the creative direction you provide.
Before submitting your video for editing, you are responsible for completing the onboarding process, including providing, where applicable:
You may choose to provide as much or as little direction as you wish.
However, by submitting your edit request, you acknowledge that the less creative direction provided, the more creative discretion Ellevated By Design must exercise when producing your edit.
If you provide clear inspiration, reference videos, and creative instructions, Ellevated By Design will make commercially reasonable efforts to produce an edit that aligns with your requested style.
If you do not provide creative direction, Ellevated By Design will use professional judgment and, where possible, reference your publicly available content to create an edit that aligns with your current brand.
Because editing is a creative service, exact replication of another creator's editing style, visual identity, pacing, or artistic work cannot be guaranteed.
You acknowledge that Ellevated By Design cannot guarantee your satisfaction with a creative vision that was not communicated before editing began.
Your editing timeline does not begin until all required onboarding information has been completed and you have submitted your Content Kickstart through the Ellevate platform.
Incomplete submissions may delay the start of your editing timeline.
Once your Content Kickstart has been successfully submitted:
In limited circumstances, additional production time may be required.
If an extension is necessary, your assigned editor will notify you before the original delivery deadline expires.
When advance notice is provided, Ellevated By Design may extend the delivery timeline by up to an additional twenty-four (24) hours.
If Ellevated By Design does not deliver your Content Kickstart within the applicable delivery window and no extension was communicated before the original deadline, you may request a refund of your Content Kickstart purchase.
This refund option applies only to delivery delays that occur without prior notice from Ellevated By Design.
Once your edit has been delivered, you will have forty-eight (48) hours to review your video and submit any revision requests through the Ellevate platform.
If no revision request is submitted within this timeframe, your edit will be considered accepted and approved.
Your Content Kickstart includes one (1) round of revisions.
A revision is intended to refine the original edit based on your submitted creative direction.
Examples of revisions may include:
Revisions do not include requests that fundamentally change the creative direction of the project.
Examples of requests that may be considered outside the scope of the Content Kickstart include, but are not limited to:
Whether a request constitutes a revision or a new edit shall be determined by Ellevated By Design in its reasonable discretion.
If a requested revision falls outside the original scope of work, Ellevated By Design may decline the request or offer to complete the additional work separately.
Once revision notes have been submitted, Ellevated By Design will make commercially reasonable efforts to complete your revision within approximately twenty-four (24) hours.
Your $97 Content Kickstart purchase may be applied as a credit toward a qualifying monthly editing membership.
To receive this credit:
If you choose not to upgrade during this period, your Content Kickstart will remain complete and no additional obligations exist between you and Ellevated By Design.
The promotional credit expires after the forty-eight (48) hour period and cannot be applied retroactively.
Except as expressly stated in Section 6 regarding delayed delivery without notice, all Content Kickstart purchases are final and non-refundable.
Because editing services involve immediate allocation of creative resources, refunds will not be provided for reasons including, but not limited to:
By submitting footage to Ellevated By Design, you represent and warrant that:
You remain the owner of your original footage.
Upon full payment, you own the final edited deliverable produced as part of your Content Kickstart.
While Ellevated By Design strives to produce high-quality edits tailored to your brand, we do not guarantee any particular business, marketing, or social media results.
This includes, without limitation:
The success of content depends on numerous factors outside Ellevated By Design's control.
Ellevated By Design reserves the right to modify this Agreement for future purchases at any time.
Any modifications will not affect Content Kickstart purchases completed before the revised Agreement becomes effective.
Your Content Kickstart must be submitted through the Ellevate platform within sixty (60) calendar days of your purchase date.
If your Content Kickstart is not submitted within this sixty (60) day period, your Content Kickstart will expire and no refund, credit, or extension will be provided unless approved by Ellevated By Design in its sole discretion.
Once your Content Kickstart has been submitted, the applicable turnaround timelines outlined in this Agreement will begin.
Ellevated By Design is proud to showcase the work created for our clients.
Unless you notify us otherwise, you grant Ellevated By Design a non-exclusive, worldwide, royalty-free license to display the final edited video created as part of your Content Kickstart for promotional, marketing, educational, and portfolio purposes. This may include, but is not limited to:
You retain ownership of your original content and the final edited deliverable.
If at any time you would prefer that your content no longer be displayed in Ellevated By Design's marketing materials, you may submit a written request through our support team. Ellevated By Design will make commercially reasonable efforts to remove your content from future marketing materials within a reasonable timeframe.
This provision does not require Ellevated By Design to recall or remove materials that have already been printed, distributed, or published through paid advertising campaigns that cannot reasonably be modified after publication.
Ellevated By Design is committed to providing a respectful and professional experience for both our clients and our team.
We reserve the right to refuse service, cancel a project, suspend platform access, or terminate a Content Kickstart if a client engages in abusive, threatening, discriminatory, harassing, or otherwise inappropriate conduct toward any member of the Ellevated By Design team.
In the event a Content Kickstart is terminated due to a violation of this section, Ellevated By Design reserves the right to retain any fees already paid to compensate for work completed and resources allocated.

Part 2

Please read this Editing Membership Agreement ("Agreement") carefully before purchasing an Ellevated By Design Editing Membership. By upgrading your account and completing your purchase, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
An Ellevated By Design Editing Membership is an ongoing creative services membership that provides professional short-form video editing services through the Ellevate platform.
Your membership includes:
By purchasing an Editing Membership, you agree to an initial minimum commitment of three (3) consecutive billing cycles.
The purpose of this commitment is to allow sufficient time for onboarding, workflow optimization, editor familiarity, and long-term creative consistency.
Memberships may not be canceled during the initial three-month commitment except as otherwise required by applicable law.
Following completion of the initial commitment, your membership will automatically continue on a month-to-month basis until canceled in accordance with this Agreement.
Following your initial three-month commitment, your membership will automatically renew each month unless written notice is provided in accordance with Section 13 of this Agreement.
Each membership includes a monthly allocation of editing credits based on your selected plan.
One (1) editing credit equals one (1) completed edited short-form video.
Examples:
Unused editing credits may roll over for up to two (2) months.
Editing credits older than two months automatically expire.
Editing credits have no cash value and may not be redeemed for cash or refunded.
Clients may submit long-form footage for repurposing into short-form content.
Each completed short-form video created from the submitted footage will use one editing credit.
Example: One podcast recording → Six completed short-form edits → Six editing credits used
Long-form footage requiring significant review, organization, or processing may require additional production time.
Ellevated By Design reserves the right to discuss production scheduling with the client when unusually large or complex source files are submitted.
Upon activation of your membership, you will be assigned:
These production days reserve dedicated editing capacity specifically for your account.
To maintain consistent turnaround times, clients agree to upload content on or before their assigned Upload Day.
If content is submitted after your assigned Upload Day, Ellevated By Design will make commercially reasonable efforts to complete your edits as quickly as possible.
However, delivery by your regularly scheduled Return Day cannot be guaranteed.
Editors may return your content during the following production cycle if necessary to maintain existing production schedules.
Your membership guarantees the minimum number of edited videos associated with your selected weekly production schedule.
Examples:
Editors may choose to complete additional edits ahead of schedule when production capacity allows.
Additional early deliveries are provided at Ellevated By Design's discretion and do not alter the ongoing production schedule.
Unless otherwise stated, all turnaround times, communication windows, deadlines, and production schedules referenced in this Agreement are measured in Business Days.
Business Days are Monday through Friday and exclude Saturdays, Sundays, and recognized U.S. federal holidays.
While editors may occasionally work outside of Business Days, they are not required to do so.
Ellevated By Design strives to respond to all client communications within one (1) Business Day.
Messages received after business hours, on weekends, or on recognized holidays will be considered received on the next Business Day.
Communication response times do not modify or extend editing turnaround timelines.
All project communication, revision requests, approvals, and project updates must be submitted through the Ellevate platform.
Clients are responsible for providing sufficient creative direction, including, where applicable:
Ellevated By Design will use commercially reasonable efforts to produce edits that align with the creative direction provided.
If little or no creative direction is supplied, Ellevated By Design will use professional judgment and reference publicly available content where possible.
Because editing is a creative service, exact replication of another creator's work or editing style cannot be guaranteed.
Brands naturally evolve over time.
If you significantly change your editing style, branding, creative direction, or content strategy after onboarding, Ellevated By Design may require updated onboarding materials, new creative references, or additional implementation time before those changes become part of your regular editing workflow.
Ellevated By Design is built around a structured production workflow designed to provide consistent turnaround times, high-quality edits, and long-term creative consistency.
By purchasing an Editing Membership, you acknowledge that the best results are achieved through a collaborative partnership between you and your assigned editor.
To help maintain your production schedule, you agree to:
Ellevated By Design will make commercially reasonable efforts to maintain your assigned editing schedule and deliver consistent results. However, repeated delays in content submission, extended periods without communication, incomplete creative direction, or failure to review edits within the required timeframes may affect turnaround times, production scheduling, editing consistency, or the ability to maintain your preferred workflow.
Our goal is to build a long-term creative partnership with every client. Maintaining open communication and following the established workflow allows both our team and our clients to achieve the highest quality results.
Each Editing Membership reserves dedicated production capacity for your account, including scheduled editing time and, where applicable, an assigned editor.
To provide consistent service to all clients, Ellevated By Design operates on a structured production schedule. While clients are welcome to upload content in advance, uploaded content will be edited according to the client's assigned production schedule unless otherwise agreed in writing.
Submitting additional content beyond your weekly editing allocation does not guarantee accelerated turnaround or additional edits beyond the minimum weekly deliverables included in your selected membership.
Likewise, submitting content after your assigned Upload Day may delay delivery beyond your scheduled Return Day. While Ellevated By Design will make commercially reasonable efforts to accommodate late submissions whenever possible, production schedules for other clients may take priority in order to maintain fairness across all memberships.
This production workflow is designed to create consistent turnaround times for all members while allowing editors the flexibility to work ahead whenever scheduling permits.
Each edited video includes one (1) round of revisions.
Revision requests must be submitted within two (2) Business Days of delivery.
If no revision request is submitted within this period, the video will be considered approved.
Revisions are intended to refine the original edit.
Requests that fundamentally change the original creative direction may be considered outside the scope of the included revision.
Examples include:
Whether a request constitutes a revision or a new project shall be determined by Ellevated By Design using reasonable commercial judgment.
Revision requests will generally be completed within one (1) Business Day.
Requests to:
require a minimum of thirty (30) days' written notice submitted through the Ellevate platform.
Plan upgrades may be processed immediately or at the beginning of your next billing cycle, depending on production availability.
Following completion of the initial three-month commitment, memberships may be paused for up to two (2) consecutive months.
During an approved pause:
Ellevated By Design will make reasonable efforts to preserve your assigned editor and production schedule during an approved pause.
However, if operational needs require staffing adjustments, Ellevated By Design cannot guarantee the availability of your previous editor, upload day, or return day upon reactivation.
Memberships may be canceled after the initial three-month commitment by providing at least thirty (30) days' written notice.
Upon cancellation:
If you later rejoin Ellevated By Design, previous editing schedules, production days, and editor assignments cannot be guaranteed.
Membership fees are billed automatically according to your selected billing cycle.
Clients are responsible for maintaining valid payment information.
If payment cannot be processed:
Unless you request otherwise, you grant Ellevated By Design a non-exclusive, worldwide, royalty-free license to display completed edited videos created during your membership for promotional, educational, portfolio, and marketing purposes.
If you later request removal, Ellevated By Design will make commercially reasonable efforts to discontinue future promotional use of the requested content within a reasonable timeframe.
This does not require removal from materials that have already been printed, distributed, or incorporated into completed advertising campaigns.
You retain ownership of all original footage submitted to Ellevated By Design.
Upon full payment, you own the completed edited videos delivered as part of your membership.
While Ellevated By Design strives to create high-performing content, we do not guarantee specific results, including but not limited to:
Content performance depends on numerous factors beyond Ellevated By Design's control.
Ellevated By Design is committed to maintaining a respectful working environment.
We reserve the right to suspend or terminate memberships if a client engages in abusive, threatening, discriminatory, harassing, or otherwise inappropriate conduct toward any member of the Ellevated By Design team.
To the fullest extent permitted by applicable law, Ellevated By Design's liability arising out of or relating to this Agreement shall not exceed the total membership fees paid by the client during the three (3) months immediately preceding the event giving rise to the claim.
Ellevated By Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business opportunities, or loss of data.
Ellevated By Design may update this Agreement from time to time.
Material changes will apply prospectively and will be communicated to active members before taking effect.
Continued use of the membership after the effective date constitutes acceptance of the updated Agreement.
